Definitions

All defined terms in these Terms of Use have the meaning assigned to them as follows:

• ABN means Australian Business Number under A New Tax System (Australian Business Number) Act 1999 (Cth).
• Agreement refers to these Terms of Use and any other terms and conditions, invoices, or work orders provided by Jobe Graphic to the Client.
• Client means any individual, organisation, or representative engaging with Jobe Graphic for services.
• Contractor refers to individuals or businesses engaged by Jobe Graphic to deliver part or all of the services.
• Confidential Information means all proprietary or sensitive data, including client files, specifications, pricing, and communications not publicly available.
• Jobe Graphic means the business operated by Ayham Ayoub, trading as Jobe Graphic (ABN: 44 347 939 141).
• Deliverables refers to any digital assets, renders, or materials produced for the Client.
• Services means product rendering, 3D visualisation, and related design or consulting work offered by Jobe Graphic.
• User means any visitor to the Jobe Graphic Website or portal, including Clients and prospective clients.
• Website means www.jobegraphic.com and related portals or subdomains managed by Jobe Graphic.

1. Acceptance of Terms

By using the Website or engaging Jobe Graphic for services, you acknowledge that you have read, understood, and agree to be bound by these Terms of Use. If you do not agree, you must not use our services or website.

2. Intellectual Property

All intellectual property rights in the materials, visuals, 3D models, animations, and assets created by Jobe Graphic remain the exclusive property of Jobe Graphic unless explicitly transferred in writing.

Clients receive a non-exclusive, non-transferable license to use the final Deliverables for the agreed-upon purpose, following full payment. Any reuse, distribution, or modification requires written consent from Jobe Graphic.

3. Use of Portfolio Work

With prior written consent, Jobe Graphic may display completed work in its portfolio or marketing materials. We respect all NDAs and confidentiality terms if applied.

4. Client Responsibilities

• Provide timely feedback and communication
• Supply accurate project specifications
• Ensure all rights to provided materials (e.g., product photos or brand assets)

5. Payment Terms

Invoices must be paid in accordance with the payment schedule detailed in the project agreement or invoice.

• A 50% non-refundable deposit is typically required to commence work
• Final payment is due before final Deliverables are released
• Jobe Graphic does not process or store card information directly (payments handled via Stripe or bank transfer)

6. Project Revisions

Clients are entitled to a fixed number of revision rounds (usually three). Additional revisions may incur fees. Delayed feedback may impact project timelines.

7. Cancellations and Termination

Either party may terminate the agreement with 14 days’ written notice. Upon termination:

• The Client must pay for work completed to date
• Jobe Graphic may retain project files until outstanding payments are cleared

No refunds are provided once concept work has begun or deliverables have been shared.

8. Limitation of Liability

Jobe Graphic will not be held liable for indirect, incidental, or consequential damages including but not limited to data loss, business interruption, or loss of income. Our total liability will not exceed the amount paid for the specific service rendered.

9. Confidentiality and NDAs

We respect client confidentiality. NDAs are welcomed and fully enforced where provided. Project files and communications are treated as private unless permission is granted otherwise.

10. Website Use

You must not misuse this Website, attempt unauthorised access, introduce malicious software, or scrape content. All content on the Website is the intellectual property of Jobe Graphic unless otherwise stated.

11. Third-Party Services

Jobe Graphic uses third-party platforms (e.g., Kitchen.co, Framer, Stripe) to manage services. While we ensure these platforms are secure, we are not liable for their privacy practices or technical issues. Please review their terms independently.

12. Changes to These Terms

We may update these Terms of Use at any time. All changes will be published on our website. Continued use of our services after changes are posted constitutes acceptance of those changes.

13. Governing Law

These Terms are governed by the laws of the State of Victoria, Australia. All disputes shall be subject to the exclusive jurisdiction of the courts in Victoria.
